Reporting must comply with the Fair Credit Reporting Act and any applicable state laws. All felony convictions, misdemeanor convictions and related activity on record are also reported. Open arrest warrants, cases awaiting trial and charges for failure to appear are also included when available and legally reportable. Laws vary state to state regarding criminal record use in hiring decisions; thus, consultation with qualified legal counsel is highly recommended.

Q: Should I order a statewide search in addition to counties or is it better to order one or the other?

A: Generally, it is acceptable to order a statewide search or the appropriate counties within the state; however, there are some states where it is recommended that you order both to get the most information. States like Arizona and Minnesota have the best coverage when both the statewide and county searches are ordered.

 

Q: Do all states offer statewide searches?

A: No. Some states do not offer statewide searches or restrict who can access them (reserved for law enforcement, etc), so a county search must be completed. States that do not offer a statewide search or where Info Cubic cannot complete the search on our clients’ behalf include California, Louisiana, Massachusetts*, Nevada, New Hampshire, Ohio, Vermont, West Virginia, and Wyoming.

Q: How far back is the record information that you report?

A: Criminal records are provided at least for the past 7 years; however, may go back further depending on the laws for that particular state. If a statewide search with a 10 years scope is ordered, Info Cubic will provide at least 10 years of criminal record information whenever possible (where the state does not limit reporting of conviction information to 7 years).

The Cube Feature

There are a number of states where a source is available where records are reported in from all counties in real-time. Where that exists, a client may want to order a Statewide Criminal Records search instead of a County Criminal Records search. Or in scenarios where they run both County Criminal and Statewide Criminal just run Statewide Criminal only.
