If you are a new company and considering a drug test program, you may be contemplating which positions to focus on or if a one-size-fits-all program is best. You may have an established company that drug tests only a select few positions within your organization. What it all boils down to is requirements, regulated positions, and the work environment of your staff.
Federal & State Requirements
When it comes to drug testing, employers must follow federal requirements for safety-sensitive positions, as well as state requirements. And, each state has different requirements. For instance, some states don’t allow random drug screening of employees, while others do allow it.
However, all employers in every state must handle job-related matters in accordance with the federal Americans with Disabilities Act (ADA), which makes it illegal to discriminate against potential or existing employees on the basis of real or perceived disabilities.
Minimizing the risk to your staff and others who come in contact with your facility or product is important when it comes to knowing which positions to drug test for. Take, for instance, the companies who staff Commercial Driver’s License (CDL) drivers. These companies work within regulated industries and, therefore, must follow the regulations for those positions, including the drug tests that are required for CDL drivers.
When looking from the outside-in, it can be difficult to know for certain which companies conduct pre-employment or post-employment testing. Many companies that drug test simply don’t advertise it. Even the Institute for a Drug-Free Workplace doesn’t publish a public list of its many corporate members.
When it comes to staffing agencies, the situation is much the same. Not all employment agencies drug test, but most of them tend to require drug screening at some point in the hiring process. Some agencies screen every candidate for drugs, whereas others only screen candidates who have been matched with jobs in which the employer requires testing.
