Montana Marijuana Employer Guidelines
“Recreational vs. personal” use of marijuana: We recognize that a majority of the country uses the term “recreational use” when referring to states that have legalized possession and use of limited amounts of marijuana for those over 21.Montana personal and medical use of marijuana.
Medical Use: As of January 2022, Montana HB 701 amended the state's lawful off-duty conduct statute to include marijuana as a lawful product. What that means is that employers cannot deny job applicants or discriminate against current employees because of their legal use of marijuana during non-working hours.
